PRIVACY POLICY OF THE MOODNOOK.COM ONLINE STORE

The administrator of personal data collected via the moodnook.com Online Store, within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) of 27 April 2016. (Journal of Laws Device EU. L No. 119, p. 1), hereinafter referred to as GDPR, and the Act of May 10, 2018 on the protection of personal data (Journal of Laws 2018.1000), there is MOOD NOOK sp. zoo based at street Równa 19D 80-067 Gdańsk , having no NIP: 5842791217 and statistical number REGON: 385514019 . e-mail address: [email protected] - hereinafter referred to as the "Administrator" and being at the same time the Online Store Service Provider and the Seller.

2. The Administrator takes special care to protect the interests of data subjects, and in particular ensures that the data collected by him is processed in accordance with the law; collected for specified, lawful purposes and not subjected to further processing incompatible with these purposes; substantively correct and adequate in relation to the purposes for which they are processed and stored in a form enabling the identification of data subjects for no longer than is necessary to achieve the purpose of processing.

3. All words, phrases and acronyms appearing on this website and beginning with a capital letter (e.g. Seller, Online Store, Electronic Service) should be understood in accordance with their definition contained in the Regulations of the Online Store available in the Regulations section.

  • PURPOSE AND SCOPE OF DATA COLLECTION

1. The purpose of collecting personal data by the Administrator is:

1.1. establishing, shaping the content, changing, performing or terminating the contractual relationship between the Service Provider (Seller) and the Service Recipient (Customer) consisting in the provision of Electronic Services via the Online Store or the conclusion and performance of the Product Sales Agreement and their delivery to the Customer.

1.2. direct marketing of the Administrator's own products or services.

2. In the case of Customers who use the Product delivery service to the Customer, the Administrator transfers the collected personal data of Customers to the extent necessary for delivery to the selected carrier:

2.1. DPD Polska Sp. z o. o based in Warsaw (registered address: ul. Mineralna 15, 02-274 Warszawa) number in the Register of Entrepreneurs of the National Court Register: 0000028368.

2.2. Inpost Sp. z o. o with its registered office in Kraków (registered office address: ul. Pana Tadeusza 4, 30-727 Kraków) KRS number: 0000543759.

3. In the case of Customers who use electronic payments or a payment card, the Administrator transfers the collected personal data of Customers only to an intermediary selected by the Customer and only to the extent necessary for the Customer to make a payment through them. The intermediary available in the Online Store is:

3.1. Autopay SA, with its registered office in Sopot, 81-718 Sopot, at 6 Powstańców Warszawy Street, registered in the District Court of Gdańsk-Północ, 8th Commercial Division of the National Court Register under KRS number 0000320590, NIP 585-13-51-185, REGON 191781561.

4. The Administrator processes the following personal data of Service Recipients (Customers): name and surname; e-mail address; contact telephone number; address (street, house number, apartment number, postal code, city, country). In the case of Service Recipients (Customers) who are not consumers, the Administrator additionally processes the company name and tax identification number (NIP).

5. Providing personal data referred to in point 2.4. is necessary for the Service Provider to provide Electronic Services as part of the Online Store or to conclude a Product Sales Agreement.

  • COOKIES AND OPERATIONAL DATA

1. Cookies are small text information in the form of text files, sent by the server and saved on the side of the user visiting the Online Store website (e.g. on the hard drive of a computer, laptop or on the memory card of a smartphone – depending on what device you use when visiting our Online Store). 2. The Service Provider processes the data contained in Cookies when visitors use the Online Store website for the following purposes:

2.1. identifying Service Users as logged in to the Online Store and showing that they are logged in;

2.2. remembering Products added to the cart in order to place an Order;

2.3. remembering data from completed Order Forms, surveys or login details to the Online Store;

2.4. adapting the content of the Online Store website to the individual preferences of the Service User (e.g. regarding colors, font size, page layout) and optimization of the use of the Online Store pages;

2.5. keeping anonymous statistics showing how the Online Store website is used and examining the needs of Service Users, excluding personal identification of the Service User.

3. By default, most web browsers available on the market accept cookies. You can define the conditions for the use of cookies using the settings of your web browser. This means that you can e.g. partially limit (e.g. temporarily) or completely disable the ability to save cookies on your computer - in the latter case, however, it may affect some functionalities of the Online Store (for example, it may be impossible to complete the Order path via the Order Form).

4. The settings of your web browser regarding cookies are important from the point of view of consent to the use of cookies by our Online Store - in accordance with the regulations, such consent may also be expressed through web browser settings.

6. The service provider also collects operational data (so-called logs – IP address, domain), which are stored for an indefinite period of time and used to generate statistics helpful in administering the Online Store. This data is aggregated and anonymous, i.e. they do not contain features identifying persons visiting the Online Store website. Logs are not disclosed to third parties

  • BASIS FOR DATA PROCESSING

1. Providing personal data by the Service Recipient/Customer is voluntary, although failure to provide the personal data indicated in the Regulations necessary to conclude a Sales Agreement or an agreement for the provision of Electronic Services results in a refusal to conclude this agreement. The data necessary to conclude a Sales Agreement or an Agreement for the provision of Electronic Services are also always indicated on the website of the Online Store.

2. The basis for the processing of the Service Recipient's/Customer's personal data is the need to perform the contract to which the Service Recipient/Customer is a party or to take action at his request before concluding it. In the case of data processing for the purpose of direct marketing of the Administrator's own products or services, the basis for such processing is also the consent of the Service Recipient/Customer.

3. The purpose of processing the Buyer's data by the Seller, provided by the Buyer in connection with purchases in the Store, is to fulfill orders. The basis for the processing of personal data in this case is:

· sales contract or actions taken at the Buyer's request aimed at concluding it (Article 6 sec. 1 lit. b GDPR),

· the Seller's legal obligation related to accounting (Art. 6 sec. 1 lit. c GDPR) and

· the legitimate interest of the Seller, consisting in the processing of data in order to establish, pursue or defend possible claims (Article 6 sec. 1 lit. f GDPR).

  • THE RIGHT TO CONTROL, ACCESS AND CORRECT YOUR DATA

1. The service recipient has the right to access and correct their personal data.

2. Each person has the right to control the processing of data concerning him or her contained in the Administrator's data set, and in particular the right to: request supplementation, updating, rectification of personal data, temporary or permanent suspension of their processing or deletion if they are incomplete, out of date, false or were collected in violation of the Act or are no longer necessary to achieve the purpose for which they were collected.

3. In the case of data processing for the purpose of direct marketing of the Administrator's own products or services, the data subject is also entitled to submit a written, reasoned request to discontinue the processing of his or her data due to his or her special situation and to object to the processing of his or her data.

4. In order to exercise the rights referred to above, you can use the options within the Account or by sending an appropriate message by e-mail to the following address: [email protected] or in writing to the Administrator's address.

  • FINAL PROVISIONS

1. The Online Store may contain links to other websites. The administrator encourages you to read the privacy policy established there after going to other websites. This privacy policy applies only to this Online Store.

2. The Administrator applies technical and organizational measures to ensure the protection of processed personal data appropriate to the threats and categories of data protected, and in particular protects the data against disclosure to unauthorized persons, removal by an unauthorized person, processing in violation of applicable regulations and change, loss, damage or destruction.

3. The Service Provider provides the following technical measures to prevent unauthorized persons from obtaining and modifying personal data sent electronically:
